Terms of Service

Welcome to Insta Notes! These Terms of Service ("Terms") govern your use of the Insta Notes website and service (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of the Service

Insta Notes is a free, browser-based tool that lets you record or upload a voice note, add an avatar, choose a theme, and generate an animated video. All processing is performed locally on your device; we do not host, transmit, or store your audio, images, or generated videos.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your Content Remains Yours

You retain all rights to the voice notes, images, and other content you provide to the Service ("Your Content"). We claim no ownership over Your Content and never access it, because it never leaves your device. You are solely responsible for Your Content and for ensuring you have the rights to use and share it.

4. Acceptable Use

You agree not to use the Service to:

• Create, distribute, or share content that is unlawful, defamatory, harassing, hateful, threatening, or discriminatory;
• Infringe the intellectual property, privacy, or other rights of any person or entity;
• Impersonate any person or entity, or misrepresent your affiliation with anyone;
• Upload content containing malware, viruses, or other harmful code;
• Attempt to disrupt, overload, or interfere with the Service or its infrastructure;
• Reverse engineer, decompile, or extract the source code of the Service except as expressly permitted by applicable law;
• Use the Service for any purpose that violates applicable law.

We may suspend or terminate access to the Service for violations of these Terms, at our sole discretion.

5. Intellectual Property

The Service itself — including its design, branding (including the "Insta Notes" name and "mr.velosofy" mark), artwork, and underlying technology — is our property or that of our licensors and is protected by applicable intellectual property laws. Your use of the Service does not grant you any ownership interest in it. Videos you generate with your own content are your own creations.

6. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that results will be accurate or reliable. Generation quality may vary depending on your browser and device.

7. Limitation of Liability

To the maximum extent permitted by law, in no event shall we, our affiliates, or our contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages. Because all processing is local, your responsibility for managing and backing up your own data is entirely your own.

8. Indemnification

You agree to indemnify and hold harmless Insta Notes, its operators, contributors, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

9. Termination

You may stop using the Service at any time by simply closing the page. We may terminate or suspend your access to the Service, in whole or in part, at any time without notice for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 3, 5, 6, 7, and 8) will survive.

10. Changes to the Service and These Terms

We may modify or discontinue the Service, or revise these Terms, at any time. When the Terms change materially, we will update the "Last updated" date and post a notice on the homepage. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation first; if that fails, through the competent courts of that jurisdiction.

12. Third-Party Services

The Service may load fonts or other resources from third-party providers (such as Google Fonts). Your use of such resources is subject to the respective providers' terms and privacy policies, and we are not responsible for those third-party services.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Insta Notes regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
